Employment Law
Severance and notice pay, reinstatement, overtime and other employee claims; mandatory mediation; employment matters for foreign employers.
Employment relationships in Türkiye are governed mainly by the Labour Law No. 4857, the Turkish Code of Obligations No. 6098 and the Labour Courts Law No. 7036.
Before filing a lawsuit for employee receivables or reinstatement, applying to a mediator is mandatory (Law No. 7036, Art. 3). For reinstatement, the application must be made within one month of the notice of termination being served (Labour Law Art. 20).
Severance pay is still calculated under Article 14 of the former Labour Law No. 1475, which remains in force. For foreign-owned companies and foreign employees in Türkiye, employment contracts, work permits under the International Labour Force Law No. 6735 and termination procedures should be aligned with Turkish law from the outset.
