Insurance law covers how insurance contracts are formed, the rights and obligations of the parties and how compensation is paid after a loss. Private insurance contracts in Türkiye are governed mainly by the insurance provisions of the Turkish Commercial Code No. 6102 and the applicable general conditions, while liability for traffic accidents falls under the Highway Traffic Act No. 2918.

The most common matters concern vehicle damage after traffic accidents. If your vehicle is damaged, you may claim the repair costs, the drop in market value that remains even after repair (diminished value), loss of use while it is off the road and, where applicable, lost earnings, from the operator (işleten) of the vehicle at fault and its traffic insurer. The fault ratio, the expert (ekspertiz) report, the car's age, mileage and damage history all affect the amount. Foreign drivers and foreign-registered vehicles are subject to the same rules; such claims may be handled through the international Green Card system.

Refused or underpaid comprehensive motor (kasko) or traffic insurance claims, the scope of cover and exclusions, alleged breaches of the duty of disclosure and insurers' recourse claims also fall within this area. After applying to the insurer, the Insurance Arbitration Commission (Sigorta Tahkim Komisyonu) or the courts may be approached depending on the dispute; the right route and time limits depend on the facts.
