Inheritance Law
Certificates of inheritance, division of the estate, wills, reduction claims and inheritance matters involving foreign heirs.
Inheritance law governs how a person's assets pass to the heirs on death, how the estate is divided among them and dispositions such as wills. The main source is the inheritance chapter of the Turkish Civil Code No. 4721 (Art. 495 et seq.).
A certificate of inheritance (mirasçılık belgesi) can be obtained from a civil court of peace or a notary (Civil Code Art. 598). An heir may disclaim the inheritance, as a rule within three months (Art. 606). Heirs entitled to a reserved portion can bring a reduction claim (tenkis) against dispositions that infringe it (Art. 560 et seq.).
Where foreign nationals inherit real estate in Türkiye, the restrictions on the acquisition of property by foreigners under the Land Registry Law No. 2644 (Art. 35) must also be taken into account. Heirs living abroad can usually handle the procedures in Türkiye through a power of attorney.
