Short answer
After a car accident in Turkey, stop, secure the scene, call 112 if anyone is hurt and wait for the police or gendarmerie; in damage-only crashes, drivers may instead sign a joint report. Damage to others is paid by the at-fault vehicle's compulsory traffic insurance, which must be claimed in writing first.

A car accident in Turkey is stressful for any visitor: different rules, a foreign language, a rental company on the phone and a flight home in a few days. The legal framework is the Highway Traffic Law No. 2918 (Karayolları Trafik Kanunu, KTK), which imposes strict liability on vehicle operators and compulsory insurance on every vehicle. Knowing a few rules protects your claim and keeps you out of trouble.
This guide covers the first hour, who pays, rental cars, foreign-registered cars and claims. For insurance disputes in general, see the insurance law overview.
What should you do right after a car accident in Turkey?
At the scene
Stop and secure the scene
Stop without creating further danger, switch on the hazard lights and place a warning triangle. Give first aid if you can.
Call 112
112 is the single emergency number in Türkiye (Turkey), also used for the police and gendarmerie (112 Emergency Call Centre). The operator can send an ambulance and alert the officers.
Do not change the scene
If there are injuries or damage and the accident does not endanger traffic or safety, leave the vehicles and traces as they are, since they help establish liability (KTK, Art. 81).
Exchange details
Show and note each other's identity, address, driving licence, vehicle registration and insurance policy number.
Wait for the officers, or sign a joint report
You must report the accident and wait for the traffic police or gendarmerie. Only if there is damage alone and all drivers agree may you record the facts in a jointly signed written report and leave.
Collect evidence and call the rental company
Take photos of positions, damage and road signs, note witnesses, and inform the rental company or your insurer at once.
Hospital costs for traffic accident victims are covered by the Social Security Institution under the public reimbursement rules, whether or not the victim has social insurance (KTK, Art. 98). Keep every medical document and receipt.
Who pays for the damage?
The operator (işleten) of a motor vehicle is liable for death, injury and property damage caused by operating it, without proof of fault (KTK, Art. 85). The operator escapes liability only by proving force majeure or gross fault of the victim or a third party, and even then only if neither the operator's side nor a vehicle defect contributed (Art. 86). Every operator must hold compulsory third-party liability insurance (zorunlu trafik sigortası), which pays up to limits set by the authorities (Art. 91; 2026 limits).
| Situation | Who pays | Legal basis |
|---|---|---|
| Damage or injury caused by an insured vehicle | That vehicle's compulsory traffic insurer, up to the policy limits | KTK Art. 85, 91, 97 |
| Injury caused by an uninsured or unidentified vehicle | The Guarantee Account (Güvence Hesabı), up to the compulsory limits; it does not pay for vehicle damage | Insurance Law No. 5684, Art. 14 |
| Damage caused by a foreign-registered vehicle | Its Green Card insurer, through the Türkiye Motor Vehicle Bureau (TMTB); if the vehicle has neither Turkish insurance nor a Green Card, the Guarantee Account covers bodily injury | KTK Art. 91; Law 5684, Art. 14 |
| Damage to your own rental car | The rental contract and any comprehensive (kasko) or damage waiver cover | Your contract |
| Loss above the policy limits, non-pecuniary damages and indirect losses such as loss of use, lost profit or rental income | The operator and the at-fault driver personally; compulsory insurance excludes these items | KTK Art. 85 and 92; tort rules |
| Cover | Limit |
|---|---|
| Material damage | TRY 400,000 per vehicle; TRY 800,000 per accident |
| Health costs | TRY 3,600,000 per person; TRY 18,000,000 per accident |
| Disability and death | TRY 3,600,000 per person; TRY 18,000,000 per accident |
Agreements that exclude or limit this statutory liability are void, and a settlement that is clearly inadequate or excessive can be annulled within two years (Art. 111).
What if you crash a rental car?
Under the KTK definition, the registered owner is the operator, and a hirer becomes the operator in cases such as long-term hire (KTK, Art. 3). In an ordinary short-term rental, the rental company is therefore generally treated as the operator, although the facts of the case can matter. Claims by other road users therefore go to the rental car's compulsory traffic insurer. As the driver, you remain personally liable for your own fault, and the rental company may claim from you under the contract.
Damage to the rental car itself depends on the contract. Read the exclusions before you sign. Under the standard comprehensive insurance conditions, damage is not covered if the driver had no required licence or was under the influence of drugs or alcohol above the legal limit, and rental contracts usually add conditions such as naming every driver. Tourists may drive with a licence recognised under international agreements or a valid international driving permit (Art. 36). Before returning the car or leaving Türkiye, get a copy of the accident report and a written damage statement.
How do you claim compensation as a tourist?
You must first apply in writing to the responsible insurer. If it does not reply in writing within 15 days, or you disagree with the answer, you may sue or apply to the Insurance Arbitration Commission (Sigorta Tahkim Komisyonu) (KTK, Art. 97; Law No. 5684, Art. 30). Since 01.09.2026, claims can also be lodged through the Joint Claims Notification Centre (Ortak Hasar İhbar Merkezi, OHİM) of the Insurance Information and Monitoring Centre, and the Alo 193 claims and complaints hotline is available (SEDDK Circular 2026/22); a claim lodged there counts as made to the insurer when it reaches the Centre. The Commission requires no mediation; for a lawsuit, mediation may be required depending on the nature of the claim. A lawsuit can be filed where the insurer's branch or agency is located or where the accident happened (Art. 110).
Only you, your legal representative, close relatives acting under your power of attorney or your lawyer may pursue the claim, and it cannot be assigned to anyone else (Law No. 5684, Additional Art. 6). Be careful with agents who offer to buy your claim.
Claims for material damage become time-barred two years after you learn of the damage and the liable person, and in any case ten years after the accident; a longer period applies if the act is also a crime with a longer limitation period (Art. 109). If people were injured, the prosecutor may open a criminal investigation, and you may be asked to give a statement before you leave.
Frequently asked questions
What should I do after a car accident in Turkey as a tourist?
Stop, secure the scene and call 112 if anyone is hurt. Exchange identity, licence, registration and insurance details, take photos and inform your rental company. If someone is injured, wait for the police or gendarmerie. In damage-only accidents, all drivers can sign a joint report instead. Never leave the scene of an injury accident without permission.
Who pays if I crash a rental car in Turkey?
Damage to other people and vehicles is paid by the rental car's compulsory traffic insurance, because in a short-term rental the rental company is generally the vehicle's operator. Damage to the rental car itself depends on your contract and any kasko or damage waiver cover. You remain personally liable for your fault and for losses above the insurance limits.
Do I need to call the police after a minor accident in Turkey?
Not always. If there is only material damage and all drivers agree, you may record the facts in a jointly signed written report and leave the scene under Article 81 of the Highway Traffic Law. If anyone is injured or the drivers disagree, call the police or gendarmerie; it is also wise to call them if the other driver has no valid insurance or licence.
How long do I have to claim compensation after a car accident in Turkey?
For material damage, two years from the date you learn of the damage and the liable person, and at most ten years from the accident. If the accident also constitutes a crime with a longer limitation period, that longer period applies. Before suing, you must apply to the insurer in writing and wait 15 days.
Can I claim compensation in Turkey after returning home?
Yes. Your written application to the insurer can be sent from abroad, and a lawyer in Türkiye can take the case to court or to the Insurance Arbitration Commission under a power of attorney signed at a Turkish consulate or apostilled at home. Keep the accident report, photos, medical records and receipts.
