Short answer
A Turkey visa overstay is penalised with a fee paid on departure, set under the Fees Law by nationality, age and length of overstay. If you leave voluntarily before the overstay is detected and pay, an overstay of less than three months brings no entry ban; longer overstays lead to bans from one month to five years.

A Turkey visa overstay happens more easily than many visitors expect: a residence permit renewal is filed late, a 90-day stay is miscounted, or illness delays a flight. The consequences range from a fee at the airport to an entry ban and, in serious cases, deportation. Acting early, before the authorities detect the overstay, makes a real difference.
This guide sets out the rules applied by the Presidency of Migration Management (Göç İdaresi Başkanlığı). For related topics, see the citizenship and immigration law overview.
What counts as an overstay in Turkey?
You overstay when you remain in Türkiye (Turkey) after your visa or visa-free period ends, or after your residence permit expires without a timely renewal application. Anyone staying longer than the visa allows, or longer than 90 days, needs a residence permit (Law No. 6458, Art. 19). The stay allowed by a visa or a visa exemption may not exceed 90 days within any 180 days (Art. 11).
If you hold a residence permit, apply for renewal from 60 days before it expires and in any case before the expiry date; the application receipt then allows you to stay until a decision is made (Art. 24).
How much is the overstay fine in Turkey?
There is no single fixed amount. The overstay penalty is a fee under the Fees Law No. 492: the residence permit fee for the period you overstayed, charged at double the normal rate but without further penalty or interest (Fees Law, Tariff 6). The rates are set on the basis of reciprocity, so the amount differs by nationality, and also by age and the length of the overstay. According to the migration authority, the exact amount is determined at the border when you leave (Istanbul migration office FAQ).
Pay it and keep the receipt. Unpaid fines have lasting effects: until you pay them, you will not be admitted to Türkiye even after an entry ban has expired.
How long is the entry ban for overstaying?
| Length of overstay | You leave voluntarily before detection and pay the fine | Fine not paid, or deported, or did not leave in time |
|---|---|---|
| Less than 3 months | No entry ban | 3 months |
| 3 to 6 months | 1 month | 6 months |
| 6 months to 1 year | 3 months | 1 year |
| 1 to 2 years | 1 year | 2 years |
| 2 to 3 years | 2 years | 5 years |
| More than 3 years | 5 years | 5 years |
The table follows the Presidency's explanation on entry bans for overstays. An overstay of less than three months also brings no ban if you received a deportation decision but left within the time given and paid the fine. By law, an entry ban lasts at most five years, but it can be extended by up to ten more years if there is a serious threat to public order or security (Art. 9).
Can you be deported for overstaying?
Yes. A deportation decision is taken against foreigners who exceed their visa or visa-free period by more than ten days, or who exceed their residence permit by more than ten days without an acceptable reason (Art. 54). The decision usually gives you 15 to 30 days to leave, although no period is given in some cases, for example where there is a risk of absconding (Art. 56).
You, your legal representative or your lawyer can challenge a deportation decision at the administrative court within seven days of notification. Unless you agree to leave, you will not be removed while the time limit runs or the case is pending, and the court decides within fifteen days of the file being complete; its decision is final (Art. 53).
What should you do if you have overstayed?
Limiting the consequences
Act before you are detected
The favourable column in the table applies only if you leave on your own initiative before the authorities find the overstay.
Check whether you can stay legally
If you are eligible for a residence permit, get advice quickly. According to the Istanbul migration office, online applications filed within 10 days after the visa or visa-free period ends are still considered.
Leave and pay at the border
Pay the fee at the border gate and keep the receipt with your passport.
Ask about any ban
Ask at departure whether an entry ban is being imposed, or have a lawyer check your record later.
Remove or challenge a ban
The Presidency may lift a ban or allow entry for a set period (Art. 9/6). A ban decision can also be challenged at the administrative court, generally within 60 days of notification (Administrative Procedure Law, Art. 7).
If you have a Turkish spouse or children, a property or a job in Türkiye, raise these ties in any application or court case; the authorities must consider family ties and length of residence when refusing or cancelling a residence permit (Art. 25). For your specific situation, individual legal advice is recommended.
Frequently asked questions
What happens if you overstay your visa in Turkey?
You pay a penalty fee when you leave, and depending on how long you overstayed and how you leave, an entry ban may be imposed. If you leave voluntarily before detection and pay, an overstay under three months brings no ban. Overstaying by more than ten days can also lead to a deportation decision under Article 54 of Law No. 6458.
How much is the fine for overstaying in Turkey?
There is no single amount. The fine is the residence permit fee for the overstayed period, charged at double the normal rate under the Fees Law. Because the rates are set on the basis of reciprocity, the amount depends on your nationality, your age and the length of the overstay. It is calculated and collected at the border when you leave.
How long is the entry ban for overstaying in Turkey?
If you leave voluntarily before detection and pay the fine, there is no ban for less than three months; three to six months brings one month, and bans rise to five years for overstays over three years. If you do not pay or are deported, bans run from three months to five years, according to the migration authority's published rules.
Can I leave Turkey if I have overstayed my visa?
Yes. You can go to the border gate, pay the penalty fee and leave; this voluntary exit before detection gives the most favourable outcome. If a deportation decision has already been issued, leave within the period stated in it and pay the fine. Keep the payment receipt, as unpaid fines block future entry.
Can an entry ban to Turkey be lifted?
Yes. Under Article 9 of Law No. 6458, the Presidency of Migration Management can lift an entry ban or allow entry for a specific period while the ban remains. You can also challenge the ban decision at the administrative court, generally within 60 days of notification. Strong family, work or property ties in Türkiye support such a request.
